National Archive – From a letter dated 15 August 2000:

“The records of court proceedings contain some works in Crown copyright and others in various private copyrights, and the mix will depend partly on whether you are dealing with criminal trials or civil, equity or common law trials. So far as the Crown copyright material is concerned you may transcribe, publish and place the contents of the documents on the Internet as you wish. This would include documents created by the court such as most writs, indictments, minutes of evidence and judgements.

Material not in Crown copyright would include most affidavits, pleadings, statements of claim and exhibits: documents originally created mostly by the parties to the action or the defendant. Since your period is 1884 – 5 this is all over 100 years old now, and the authors will have been dead for at least 50 years. This means that you may benefit from a provision of the 1956 Copyright Act allowing the reproduction of copyright material without permission, so long as you do not know who the current copyright owner is.

You may also reproduce your photocopies of National Archive documents. If you wished for higher quality, the Image Library here would be happy to supply photographs and permission to reproduce them.

In all cases, please acknowledge the National Archive as the custodian of the original documents; the form you suggest will be fine. Please also give the full document references.”

ask the Library for permission as there is no copyright in
transcribing.

2. Placing the transcribed text on the Internet there would still not
be any infringement in copyright.

3. You can pass the transcription on to a third party if the
publication is before 1931

4. Any transcribed text after 1931 publication you will need to check
with the copyright holder.
